Acceptance of Terms

By accessing and using DiabetesTracker Pro ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

DiabetesTracker Pro is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease. This service is for informational and educational purposes only and should not replace professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition.

Use License

Permission is granted to temporarily download one copy of DiabetesTracker Pro per device for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

  • modify or copy the materials
  • use the materials for any commercial purpose or for any public display
  • attempt to reverse engineer any software contained in the service
  • remove any copyright or other proprietary notations from the materials

User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for safeguarding the password and for maintaining the security of your account.

  • You must be at least 13 years old to use this service
  • You are responsible for all activities that occur under your account
  • You must notify us immediately of any unauthorized use of your account
  • We reserve the right to terminate accounts that violate these terms

Prohibited Uses

You may not use our service:

  • For any unlawful purpose or to solicit others to perform unlawful acts
  • To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
  • To infringe upon or violate our intellectual property rights or the intellectual property rights of others
  • To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
  • To submit false or misleading information
  • To upload or transmit viruses or any other type of malicious code

Subscription and Billing

Subscription Plans

  • Free Plan: Basic features with limitations
  • Premium Plan: Advanced features with monthly/annual billing
  • Pro Plan: Full feature access with monthly/annual billing

Billing Terms

  • Subscriptions automatically renew unless cancelled
  • Payment is charged in advance on a monthly or annual basis
  • No refunds for partial months of service
  • Price changes will be communicated with 30 days notice

Data Ownership and Privacy

You retain ownership of all data you input into DiabetesTracker Pro. We process your data in accordance with our Privacy Policy. You grant us a limited license to use your data solely for the purpose of providing our services.

  • Your health data belongs to you
  • We use your data only to provide and improve our services
  • You can export your data at any time
  • We may use anonymized, aggregated data for research and improvement purposes

Limitation of Liability

In no event shall DiabetesTracker Pro or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the service, even if DiabetesTracker Pro or its authorized representative has been notified orally or in writing of the possibility of such damage.

Service Availability

We strive to maintain high availability but cannot guarantee uninterrupted service. We may temporarily suspend service for maintenance, updates, or other operational reasons. We will provide advance notice when possible.

Termination

You may terminate your account at any time by contacting us or using the account deletion feature. We may terminate or suspend your account if you violate these terms. Upon termination:

  • Your access to the service will be immediately revoked
  • Your data will be retained for 30 days for recovery purposes
  • You may export your data during this 30-day period
  • After 30 days, your data will be permanently deleted

Changes to Terms

We reserve the right to modify these terms at any time. We will provide notice of significant changes via email or through the service. Your continued use of the service after changes constitutes acceptance of the new terms.

Governing Law

These terms shall be governed and construed in accordance with the laws of the Province of Alberta, Canada, without regard to its conflict of law provisions. Any disputes arising from these terms shall be resolved in the courts of Edmonton, Alberta, Canada.
